Welcome to Poststack™ ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our digital marketing agency directory (poststack.ai) and social media content scheduling tool (app.poststack.ai), including our website at https://poststack.ai, our scheduling application at https://app.poststack.ai, and all related services, features, and content.
Trademark Notice: Poststack™ is a trademark. All rights reserved. Unauthorized use of this trademark is strictly prohibited.
By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the service.
2. Acceptance of Terms
By accessing and using Poststack™, you accept and agree to be bound by the terms and provision of this agreement.
These Terms apply to all users of the service, including without limitation users who are browsers, agencies, contributors of content, and users of our social media scheduling service.
Age Requirement: Our services are intended for business and professional use by individuals aged 18 and above. If you are under 18, you may not use our services. By using our services, you represent and warrant that you are at least 18 years old.
3. Description of Service
Poststack™ provides two integrated services:
Directory Service (poststack.ai)
- Provides a platform for discovering and connecting with digital marketing agencies
- Allows agencies to create and manage their business profiles
- Facilitates connections between businesses and marketing service providers
- Offers content and resources related to digital marketing
Social Media Scheduling Service (app.poststack.ai)
- Enables scheduling and publishing content to multiple social media platforms
- Supports Facebook, Instagram, Twitter/X, LinkedIn, TikTok, YouTube, Pinterest, and other social networks
- Provides a content calendar and post queue management
- Offers analytics and insights for published content
- Connects to social media platforms via their official APIs
We reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
4. User Accounts and Registration
Account Creation
Some features of our service may require you to create an account. You are responsible for:
- Providing accurate and complete information during registration
- Maintaining the security of your account credentials
- Keeping your account information current and accurate
- All activities that occur under your account
Agency Claims
Agencies may claim and verify their listings by:
- Proving ownership or authorization to represent the agency
- Providing valid contact information
- Agreeing to maintain accurate profile information
5. User Conduct
You agree not to use the service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others, including intellectual property and privacy rights
- Submit false, misleading, or fraudulent information
- Impersonate another person or entity
- Spam, harass, or abuse other users
- Distribute malware or engage in hacking activities
- Scrape or collect data without permission
- Interfere with the service's operation or infrastructure
- Use the Poststack™ trademark without authorization
Social Media Scheduling Service - Additional Restrictions
When using our scheduling service, you additionally agree not to:
- Publish content that violates the terms of service of any connected social media platform
- Engage in spam, automated posting, or bulk posting that violates platform rate limits
- Share content that infringes copyright, trademark, or other intellectual property rights
- Publish illegal, harmful, threatening, abusive, or offensive content
- Misuse API access or attempt to circumvent rate limits or usage quotas
- Use automation tools or bots in violation of platform policies
- Share personal information of others without their consent
- Attempt to access social media accounts you don't have authorization to use
Important: You are solely responsible for ensuring that content you publish through our service complies with all applicable laws, regulations, and third-party platform terms of service.
6. Content and Listings
Agency Listings
Agency listings on our platform:
- May be created by us based on publicly available information
- Can be claimed and verified by authorized representatives
- Are subject to our review and approval process
- Must be accurate and not misleading
Content Guidelines
All content submitted to our platform must:
- Be accurate and truthful
- Comply with applicable laws
- Not infringe on third-party rights
- Not contain offensive or inappropriate material
7. Trademark & Intellectual Property
Poststack™ Trademark
Poststack™ (the "Mark") is a trademark. A trademark application has been filed and the Mark is being used in commerce with the TM symbol (™) to denote common law trademark rights.
Trademark Usage: You may not use the Poststack™ trademark, name, logo, or any confusingly similar marks without prior written permission from the trademark owner. This includes:
- Using "Poststack" or similar variations in your business name, domain name, or product name
- Reproducing, displaying, or distributing the Poststack™ wordmark or logo
- Creating derivative works based on the Poststack™ brand
- Implying endorsement, sponsorship, or affiliation with Poststack™ without authorization
All rights in the Poststack™ trademark are expressly reserved. Unauthorized use may result in legal action.
Our Content & Service
The service and its original content, features, software, code, designs, and functionality are and will remain the exclusive property of Poststack™ and its licensors. The service is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of India and international treaties.
Your Content
By submitting content to our service (including agency profiles, scheduled social media posts, images, and other materials), you:
- Retain full ownership of your content
- Grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your content in connection with operating and providing our services
- Represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to submit such content
- Agree not to submit content that infringes on third-party intellectual property rights, privacy rights, or other legal rights
- Acknowledge that content published to social media platforms becomes subject to those platforms' terms and licenses
Third-Party Trademarks
Facebook, Instagram, Twitter, X, LinkedIn, TikTok, YouTube, Pinterest, and other social media platform names and logos are trademarks of their respective owners. Our use of these names is for identification purposes only and does not imply endorsement by or affiliation with these companies.
8. Social Media Integration & Platform Terms
Connecting Social Media Accounts
Our scheduling service allows you to connect and authorize access to your social media accounts on various platforms including Facebook, Instagram, Twitter/X, LinkedIn, TikTok, YouTube, Pinterest, and others. By connecting your accounts, you:
- Authorize us to access and use your account data as necessary to provide the scheduling service
- Confirm that you have the legal right and authority to connect and manage the social media accounts
- Understand that we will use each platform's official APIs to publish content on your behalf
- Accept that published content will be governed by the respective platform's terms of service
Third-Party Platform Terms
Important: When you connect a social media account and publish content through our service, your content and account usage are subject to that platform's terms of service, community guidelines, and privacy policies. These include but are not limited to:
- Facebook Terms of Service and Community Standards
- Instagram Terms of Use and Community Guidelines
- Twitter/X Terms of Service and Rules
- LinkedIn User Agreement and Professional Community Policies
- TikTok Terms of Service and Community Guidelines
- YouTube Terms of Service and Community Guidelines (including Google Privacy Policy)
- Pinterest Terms of Service and Community Guidelines
- Any other connected platform's applicable terms and policies
You are solely responsible for complying with all third-party platform terms. We are not responsible for any violations of platform policies or any actions taken by platforms against your accounts.
User Responsibility for Published Content
You acknowledge and agree that:
- You are solely responsible for all content you schedule and publish through our service
- We act only as a technical intermediary to facilitate publishing your content
- You must comply with all applicable laws when publishing content, including privacy laws, copyright laws, and advertising regulations
- You are responsible for obtaining all necessary rights, licenses, and consents before publishing content about or containing third parties
- Published content can be shared globally and you understand the implications of public posting
- You must not publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
API Rate Limits & Service Quotas
Social media platforms impose API rate limits and usage quotas. We may impose our own usage limits to ensure fair access and comply with platform requirements. These limitations may include:
- Maximum number of posts per hour/day per platform
- Maximum number of connected accounts
- Data retrieval and analytics refresh frequencies
- Storage limits for scheduled content and media
We reserve the right to modify usage limits at any time. Exceeding rate limits may result in temporary service restrictions or account suspension.
Platform Changes & Service Disruptions
Social media platforms may change their APIs, policies, or features at any time. We are not responsible for:
- Changes to platform APIs that affect our service functionality
- Platform outages or disruptions that prevent content publishing
- Platforms discontinuing API access or features we rely on
- Failed posts due to platform errors, maintenance, or policy violations
We will make reasonable efforts to adapt to platform changes, but we do not guarantee uninterrupted service for any specific social media platform.
9. Payment & Subscriptions
Merchant of Record
Dodo Payments acts as our Merchant of Record for all payment processing. When you subscribe to our paid services, you are entering into a transaction with Dodo Payments, who will:
- Process and collect payments on our behalf
- Handle tax calculations, collection, and remittance based on your location
- Manage chargebacks and payment disputes
- Store payment information securely in compliance with PCI DSS standards
- Issue invoices and receipts for your purchases
Your payment information and transactions are subject to Dodo Payments' terms and privacy policy. We do not directly store or process your full credit card information.
Subscription Plans & Billing
Our social media scheduling service may offer various subscription plans with different features and pricing. By subscribing, you agree that:
- Subscriptions automatically renew at the end of each billing period unless canceled
- You will be charged the then-current subscription price at each renewal
- We may change subscription prices with at least 30 days advance notice
- You are responsible for maintaining valid payment information
- Failed payments may result in service suspension or termination
Taxes
All prices are exclusive of applicable taxes unless otherwise stated. Dodo Payments will automatically calculate and collect applicable taxes (VAT, GST, sales tax, etc.) based on your billing location. You are responsible for paying all applicable taxes.
Refund Policy
General Policy: Subscription fees are generally non-refundable except as required by law or as explicitly stated in your subscription terms.
Exceptions: We may provide refunds at our sole discretion in the following cases:
- Significant service outages that prevent use of core features for extended periods
- Billing errors or duplicate charges
- Service cancellation within 7 days of initial subscription (for new customers only)
- As required by applicable consumer protection laws

Cancellation
You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:
- Your subscription will remain active until the end of the current billing period
- You will not be charged for subsequent billing periods
- You will retain access to paid features until the subscription expires
- No refunds will be provided for unused portions of the current billing period (except as noted above)
Free Trials & Promotional Offers
We may offer free trials or promotional pricing from time to time. These offers are subject to additional terms which will be clearly disclosed at the time of signup. Unless canceled before the trial ends, you will be automatically charged for a paid subscription.
10. Privacy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.
By using our service, you consent to the collection and use of your information as described in our Privacy Policy.
11. Disclaimers
Directory Service: We provide a directory service and do not endorse or guarantee the quality, reliability, or performance of any agencies listed on our platform.
Third-Party Content: We are not responsible for the accuracy, completeness, or quality of third-party content, including agency profiles and user-generated content.
Business Relationships: We do not mediate or resolve disputes between users and agencies. Any business relationships formed through our platform are solely between the involved parties.
Service Availability: We do not guarantee uninterrupted or error-free service availability.
Social Media Scheduling Service - Additional Disclaimers
Platform API Availability: Our scheduling service depends on third-party social media platform APIs. We do not guarantee continuous availability of any specific platform integration. Platforms may change, restrict, or discontinue API access at any time without notice.
Publishing Reliability: While we strive to publish your scheduled content reliably, we cannot guarantee successful delivery due to factors including but not limited to: platform API outages, rate limiting, policy violations, account restrictions, network issues, or content format incompatibilities.
Third-Party Platform Changes: Social media platforms may change their features, policies, API capabilities, or content formats at any time. We are not responsible for how these changes affect our service functionality or your scheduled content.
Content Moderation: Social media platforms may remove, hide, or restrict your published content based on their own policies and algorithms. We have no control over platform content moderation decisions.
Account Security: While we implement security measures, you are responsible for maintaining the security of your Poststack™ account and your connected social media accounts. We are not liable for unauthorized access resulting from compromised credentials.
"AS IS" Service: THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
12. Limitation of Liability
To the fullest extent permitted by law, Poststack™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the service
- Failed or delayed social media posts
- Third-party platform changes, outages, or restrictions
- Unauthorized access to your accounts or content
- Errors, viruses, or technical malfunctions
- Actions or inactions of third-party platforms
Our total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) shall not exceed the amount paid by you, if any, for accessing the service during the 12 months preceding the incident, or $100 USD, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Poststack™ and our affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of the service
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
- Any content you submit, schedule, or publish through the service
- Your violation of any laws or regulations
- Your violation of third-party platform terms of service
- Content published to social media platforms on your behalf
- Unauthorized use of the Poststack™ trademark
14. Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the service will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.
15. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015, or through the courts of competent jurisdiction in India.
16. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms.
